Fees

Lawyer's fees are due under a written fee agreement, the signature of which is mandatory, subject to emergencies or force majeure or intervention under legal or legal aid.

The amount of fees is freely determined in accordance with different criterias.

According to article 11 of the National Internal Regulations of the profession of lawyer, "the remuneration of the lawyer depends, in particular, on each of the following elements in accordance with custom :

  • The time spent on the case;
  • The research work;
  • The nature and difficulty of the case;
  • The importance of the interests involved;
  • The incidence of fees and charges of the firm to which he belongs ;
  • His reputation, titles, seniority, experience and specialization he holds;
  • The advantages and the results obtained for the benefit of the client by his work, as well as the service rendered to him;
  • The client's financial situation. "

The amount of fees is also defined by the amount of emoluments, rights, disbursements and costs related to any proceedings initiated.

The fee can be set according to the time spent or on a lump sum basis, depending on the case:

  • The hourly rate consists of quantifying the exact working time spent on the file;
  • The flat rate covers all of the costs.

It is strictly forbidden to entirely set the lawyer's fees according to the legal outcome of the case.

Pursuant to the provisions of Articles L.612-1 et seq. of the French Consumer Code, the client has a possibility, in the event of a dispute, to refer to the Consumer Mediator at the French National Bar Council (CNB) :
